Payment Policy
This Payment Policy governs payments for orders placed through sacrecare.com (the “Website”), operated by Sacre Group S.A.R.L., trading as Sacre Care, a company duly incorporated and existing under the laws of the Republic of Lebanon, (the “Company”, “we”, “us” or “our”).
This Payment Policy forms an integral part of the Website's Terms and Conditions. By placing an order and submitting payment, the customer (the “Customer” or “you”) agrees to this Payment Policy.
“Currently, only cash on delivery is available. The online payment terms below will apply once online payment is enabled on our website.”
1. Accepted payment methods
The Customer may pay for an order using the payment methods made available on the Website at the time of checkout, which may include:
- (a) credit or debit cards;
- (b) online or electronic payment methods;
- (c) cash on delivery, where available; and/or
- (d) any other payment method offered by the Company from time to time.
Available payment methods may vary depending on the order, Product, delivery location or other applicable conditions.
The Company may add, remove, suspend or restrict a payment method at any time.
2. Payment information
The Customer is responsible for providing complete, accurate and valid payment information.
By submitting payment information, the Customer confirms that he/she is authorized to use the selected payment method and authorizes the relevant amount to be charged or collected in connection with the order.
The Company may refuse or cancel an order where payment information is invalid or incomplete, payment authorization is refused, fraud or unauthorized use is reasonably suspected, or payment cannot otherwise be completed.
The Customer shall not use any payment method without the authorization of its lawful holder.
3. Prices and currency
Product prices shall be displayed on the Website in the applicable currency or currencies.
Before confirming the order, the Customer will be informed of the total amount payable, including the Product price and any applicable taxes, delivery charges or other charges required to be disclosed.
Where the Customer uses a payment method denominated in a currency different from the currency of the transaction, the Customer's bank or payment service provider may apply its own exchange rate, conversion fees or other charges. Such charges are determined by the relevant provider and are outside the Company's control.
4. Payment authorization
Online payments may be subject to authorization and verification by the Customer's bank, card issuer or payment service provider.
A payment may be refused or delayed for reasons outside the Company's control, including insufficient funds, payment limits, incorrect payment information, security verification or suspected fraud.
The Company shall not be responsible for a payment refusal or delay caused by the Customer's bank, card issuer or payment service provider.
The Customer remains responsible for ensuring that payment is successfully completed.
5. Payment does not constitute acceptance of an order
Successful payment or authorization of payment does not, by itself, constitute acceptance of an order by the Company.
Orders remain subject to Product availability, verification and acceptance in accordance with the Terms and Conditions.
Where an order cannot be accepted after payment has been made, the amount due to the Customer shall be refunded or the payment authorization released, as applicable.
6. Cash on delivery
Where cash on delivery is available, the Customer shall pay the full amount due at the time of delivery using the payment method permitted for such delivery.
The Customer is responsible for ensuring that payment can be made upon delivery.
The Company may restrict or withdraw cash-on-delivery availability in case of repeated refusal of orders, failed deliveries, suspected misuse or fraud, or other reasonable operational or security concerns.
Any additional fee applicable to cash on delivery shall be disclosed before the Customer confirms the order.
7. Payment security
Online payments may be processed through third-party banks, payment gateways or payment service providers.
The Company takes reasonable measures to use appropriate payment processing arrangements but does not control the independent systems of banks, card issuers or third-party payment providers.
The processing of payment information may therefore also be subject to the terms, security measures and privacy practices of the relevant payment service provider.
To the extent permitted by applicable law, the Company shall not be liable for a failure, interruption, security incident or unauthorized act occurring exclusively within a third-party payment provider's systems and outside the Company's reasonable control.
Personal data processed in connection with payments shall be handled in accordance with the Company's Privacy Policy and applicable law.
8. Payment verification and fraud prevention
The Company may carry out reasonable verification procedures before processing or accepting an order.
The Company may request additional information or verification where reasonably necessary to confirm the identity of the Customer, the validity of the payment method or the legitimacy of the transaction.
An order may be suspended, refused or cancelled where:
- (a) the Company cannot reasonably verify the payment;
- (b) the payment method appears to have been used without authorization;
- (c) fraudulent, suspicious or unusual activity is reasonably suspected;
- (d) information provided by the Customer is inconsistent or incomplete; or
- (e) processing the payment or order could expose the Company to legal, financial or security risk.
Any personal information obtained for verification purposes shall be processed in accordance with the Privacy Policy and applicable law.
9. Failed, declined or incomplete payments
An order may not be processed or may be suspended or cancelled where payment is declined, reversed, incomplete or otherwise unsuccessful.
The Company is not responsible for fees imposed directly by the Customer's bank, card issuer or payment service provider as a result of a declined or unsuccessful transaction, except where such fees result from a fault legally attributable to the Company.
Where the Customer believes that an amount has been charged despite receiving a failed-payment notification, the Customer should contact the Company and his/her payment provider so that the transaction may be verified.
10. Pricing and payment errors
The Company takes reasonable care to ensure that prices and payment information displayed on the Website are accurate.
Where an obvious pricing, calculation, technical or payment error occurs, the Company may correct the error before accepting the order.
Where an order has been placed or payment made on the basis of an obvious error, the Company may cancel the affected order and refund any amount received, subject to applicable law.
The Company shall not intentionally alter the price of a Product after an order has been validly accepted, except where required by applicable law or with the Customer's agreement.
11. Refunds
Where a Customer is entitled to a refund, the refund shall be processed in accordance with this Policy and the Company's Cancellation, Return and Refund Policy.
Unless otherwise agreed or required by applicable law, refunds for payments made electronically shall normally be made through the same payment method used for the original transaction.
The time required for the refunded amount to appear in the Customer's account may depend on the relevant bank, card issuer or payment service provider and may therefore be outside the Company's control.
The Company shall not be responsible for processing delays attributable solely to the Customer's bank, card issuer or payment provider after the Company has properly initiated the refund.
Where cash on delivery was used, an approved refund may be made by the method communicated by the Company in accordance with the Cancellation, Return and Refund Policy.
12. Chargebacks and payment disputes
If the Customer believes that a payment is incorrect or unauthorized, the Customer should promptly contact the Company so that the matter can be investigated.
The Customer shall not knowingly initiate a fraudulent, false or abusive chargeback or payment dispute. The Company may refuse future orders from a Customer who has initiated a fraudulent, false or abusive chargeback or payment dispute.
The Company may provide the relevant bank, card issuer or payment service provider with information reasonably necessary to investigate or defend a payment dispute, subject to applicable law and the Privacy Policy.
Nothing in this Article prevents a Customer from exercising any legitimate right to dispute an unauthorized or incorrect transaction.
13. Payment records
The Company may maintain electronic records of orders, payments, refunds and related transactions for accounting, tax, legal, regulatory, fraud-prevention and record-keeping purposes, subject to applicable data protection requirements.
The Customer should retain the order confirmation, invoice, receipt and any other relevant payment record.
14. Third-party payment providers
Where a payment is processed through a third-party provider, the Customer may also be subject to that provider's applicable terms and conditions.
The Company is not responsible for independent charges, exchange rates or services imposed or provided directly by a third-party payment provider and outside the Company's control.
Nothing in this Article limits any liability of the Company that cannot lawfully be excluded.
15. Changes to this payment policy
The Company may amend this Payment Policy from time to time to reflect changes in payment methods, Website operations, applicable law or regulatory requirements.
The updated Policy shall be published on the Website together with its effective date.
Unless otherwise required by applicable law, the Payment Policy applicable to an order shall be the version in force when the order was placed.
16. Applicable law
This Payment Policy shall be governed by the laws of the Republic of Lebanon and shall be read together with the Website's Terms and Conditions.
Nothing in this Policy shall exclude, restrict or waive any right or protection that cannot lawfully be excluded or restricted under applicable Lebanese law.
